Terms of Service
Welcome to Carigar Fleet Management. By accessing, enrolling, or utilizing the GetCarFleet platform, corresponding applications, hardware telemetry bridges, and associated services (the "Services"), you agree to be bound by the obligations outlined in these Terms of Service. If you are entering into this agreement on behalf of a corporation or other legal fleet operating entity, you represent that you possess the authority to bind such entity to these Terms.
1. License and Access Restrictions
Subject to your continual payment of application fees and adherence to operational rules, Carigar grants your organization a non-exclusive, term-limited, non-transferable right to access the cloud-based fleet dashboard.
Under this license, you strictly agree NOT to:
- Reverse engineer, decompile, or aggressively emulate the Carigar OS API architecture.
- Attempt to bypass our rate limits or hardware-polling caps intentionally to degrade service stability.
- Use the Services for illicit tracking without explicit driver consent, contraband logistics, or any operations directly violating state/national transportation laws.
- Resell the telemetry interface as a white-labeled product without holding a distinct Enterprise Partnership contract.
2. Service Level Agreements (SLA) & Uptime Guarantees
We recognize that modern mobility teams cannot survive blind spots. Carigar operates on highly redundant cloud networks.
- Professional Tier: Subscriptions at this level receive best-effort email and ticket support operating during standard business hours. While we target 99.5% uptime, this tier does not guarantee specific remediation times.
- Enterprise Tier: Organizations utilizing 100+ vehicles under a custom contract are protected by a binding 99.9% uptime SLA, inclusive of robust penal clauses, dedicated Technical Account Management, and 24/7 prioritized engineering intervention.
3. Account Management and Security
Administrators are entirely responsible for the distribution of roles within their organization hierarchy (e.g., granting "Admin" vs "Hub Manager" rights). Any actions recorded under your organization's credentials, whether malicious or negligent, remain the legal responsibility of your corporate entity. Carigar will not be liable for losses deriving from compromised organizational accounts due to weak internal operational security.
4. Pricing, Billing, and Taxation
Our financial architecture is explicit:
- Automated Billing: "Professional" plans operate via recurring subscription protocols. Failure to resolve negative account balances will result in a 7-day grace cycle before dashboard degradation, and a 14-day cycle before telemetry pipeline suspension.
- Taxation (GST): All quoted pricing is conventionally exclusive of applicable taxes unless otherwise noted. For Indian entities, standard 18% GST (CGST/SGST/IGST as applicable) will be appended, and invoices will display our official GSTIN.
- Refunds: All payments are non-refundable unless a catastrophic software failure breaching an Enterprise SLA warrants a prorated credit generation. We highly recommend utilizing our extensive "Start Free Trial" tier before deploying capital.
5. Telemetry Accuracy and Limitations of Liability
While Carigar integrates with advanced CAN bus nodes and accurate GPS receivers, the inherent nature of wireless communication involves packet drops—particularly in remote geographies and subterranean parking facilities. Carigar presents data "as-is".
To the maximum extent permitted under law, Carigar shall not be liable for:
- Consequential, indirect, or punitive business losses incurred via fleet downtime.
- Penalties levied by clients due to your SLA breaches, even if tangentially related to a telemetry outage.
- Any liability exceeding the total amount your organization paid to Carigar over the consecutive 6 months prior to the incident initiating the claim.
6. Termination
Organizations can terminate their utilization of Carigar at any time without punitive break-fees, effectively ending the relationship at the closure of the current billing cycle. Carigar holds the sovereign right to instantly disable accounts found in criminal violation, committing intellectual property infringement, or intentionally damaging server infrastructures.
